Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Going Merry LLC (“we”, “us”, or “our”) governing your use of the GoingMerryLine app and related services (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use the App. By using the App you represent that you meet these requirements.

2. Your account

You sign in with Sign in with Apple. You are responsible for maintaining the security of the Apple ID used to access the App. Your account is intended to be active on one device at a time; signing in on a new device will end your session on the previous one. You agree to provide accurate information and to keep it current.

3. Subscriptions, billing, and renewal

• Access to phone numbers and calling/messaging features requires a paid subscription purchased through the Apple App Store.
• Payment is charged to your Apple ID at confirmation of purchase.
• Auto-renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
• Managing & cancelling. You can manage or cancel your subscription in your iPhone's Settings → your name → Subscriptions. Cancellation takes effect at the end of the current billing period.
• Refunds are handled by Apple in accordance with the App Store's policies; we generally cannot issue refunds directly.
• Number release. If a subscription lapses, we hold the associated number for a short grace period. If it is not renewed within that window, the number is released and may be reassigned. A released number cannot be guaranteed to be recoverable.

4. Acceptable use

You agree not to use the App to:

• Send spam, bulk, automated, or unsolicited calls or messages.
• Harass, threaten, defraud, impersonate, or harm others.
• Violate any applicable law, regulation, or telecommunications rule, including those governing marketing and consent (such as the TCPA and similar laws).
• Transmit unlawful, infringing, or malicious content.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the App or its systems.

We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for us or our providers. The App is intended for personal, non-emergency use.

5. Emergency services

The App does not support calls to emergency services (such as 911 or 112). It is not a replacement for your primary phone line. Always use your carrier's native dialer or another reliable means to contact emergency services.

6. Telephony and third-party services

Calls and messages are carried over the public phone network by third-party providers. Service quality may depend on network conditions, your device, and your internet connection. Your use of the App also relies on services from Apple and our subscription and infrastructure providers, each subject to their own terms.

Your use of text messaging is also governed by our Messaging Policy, which describes the messages we send, consent, message frequency, rates, and how to use STOP and HELP.

7. Intellectual property

The App, including its software, design, and content, is owned by Going Merry LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes in accordance with these Terms.

8. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any number will remain available.

9. Limitation of liability

To the maximum extent permitted by law, Going Merry LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Going Merry LLC from any claims, damages, or expenses arising out of your use of the App, your content, or your violation of these Terms or applicable law.

11. Changes to the App or Terms

We may modify or discontinue features, and we may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide notice in the App. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in Wyoming, unless applicable law requires otherwise.

13. Apple App Store terms

This agreement is between you and Going Merry LLC only, not with Apple. Apple is not responsible for the App or its content. To the extent any subscription is purchased through the App Store, the Apple Media Services Terms and Conditions, including the standard end-user license agreement (EULA), also apply.
